TERMS AND CONDITIONS

PREAMBLE



These general terms and conditions of sale apply to all products offered by LIZE CREATIONS on its website www.zede-paris.com.



They are designed to govern all transactions (deadlines, prices, guarantees) on the site and thus protect both the customer and the company through a transparent legal basis.



These general terms and conditions of sale are agreed between:



The company LIZE CREATIONS, SARL with a capital of €7622.45, whose registered office is located at 81, rue du Temple 7003 Paris, registered with the Paris trade and companies register under number B 414.115.717 (97 B 14159), hereinafter referred to as "The seller, LIZE CREATIONS or ZEDE", on the one hand, and any non-professional natural person wishing to make a purchase on the LIZE CREATIONS website www.zede-paris.com, hereinafter referred to as "the customer, the consumer or the buyer", on the other hand.



Article 1: PURPOSE



These general terms and conditions of sale aim to define, solely by virtue of the relationships established online, the reciprocal rights and obligations of the parties and the various stages of the ordering process. The Customer acknowledges having read them upon order confirmation and expressly declares their unreserved acceptance.



The Client is clearly informed and acknowledges that the Site is intended for end consumers. Professionals must contact LIZE CREATIONS' sales department to obtain separate contractual terms.



The seller reserves the right to modify the general terms and conditions of sale of the website www.zede-paris.com at any time. The application of the new conditions will then take effect on the date of the customer's order.



Article 2: PRODUCT CHARACTERISTICS



The items visible on the site are available for sale while stocks last.



LIZE CREATIONS strives to present the product descriptions available on the Site as accurately as possible. However, photographs and texts are for illustrative purposes only and have no contractual value. Unless otherwise stated on the Site, all Products sold by LIZE CREATIONS are new and comply with current European legislation and applicable French standards.



Article 3. PRICE



The prices of the items are inclusive of all taxes and are in euros. They take into account any applicable discounts as well as VAT, at the rate applicable on the day of the order. The prices shown on the Site do not include delivery charges, which will be specified and added to the total order amount.



LIZE CREATIONS reserves the right to modify its sales prices at any time. Orders placed are then invoiced at the rates in effect at the time the order is placed.



Article 4. ORDERING CONDITIONS

Article 4.1. Order



To order one or more items, proceed as follows:

- Click on the item of your choice to access the product page of the selected item.



- Click on "Add to cart", a window will appear.



- Next, confirm the item by clicking "Order" or continue shopping by clicking "Continue Shopping". In the latter case, you can add multiple items by clicking the "shopping cart" icon in the top right corner of the page and then clicking "Checkout" to complete the payment.



- Once the item has been validated, check the accuracy of the order information (product, color, quantity, price) on the summary sheet and click on "Proceed to payment" to adjust the amount.



- You must then "create an account" or enter the information in the "Quick Order" form. This is to register the information for billing and delivery.



- Check the accuracy of the information and then press "Pay for the order"



- You are then invited to choose the delivery method that suits you best.



- Read the terms and conditions and tick "I accept the terms and conditions and adhere to them without reservation" and click on "Pay for the order" to finalize the purchase.



- Pay for the order, then confirm.



- Once the purchase is made, the Customer will receive a confirmation email summarizing the order.



Any order finalized implies that the customer definitively and irrevocably accepts their purchase and these general terms and conditions of sale.



After validation, the order is sent to LIZE CREATIONS for processing. The Customer can only modify or cancel it by contacting Customer Service by phone or email before the package is shipped.



If a product is unavailable, the customer will be informed as soon as possible. If payment is processed for an unavailable product, LIZE CREATIONS undertakes to exchange the product for another available product of the same value, to offer a credit note, or to refund the customer for the product in question within 15 days.



The customer can deactivate their account at any time if they wish by sending an email to contact@zede-paris.com.



Article 4.2. Order restrictions



The sale of ZEDE products on the website www.zede-paris.com is intended solely for buyers whose delivery address is in mainland France. Our computer system configuration does not allow purchases outside of France. However, if the system proceeds with the sale despite this programming, LIZE CREATIONS reserves the right to refuse the order afterward.


Article 5. PAYMENT TERMS
Article 5.1. Payment Method


All orders are payable in euros. To pay for the order, the customer can choose from the following payment methods:
- Credit card (Visa, MasterCard, Maestro)
- PayPal account.

LIZE CREATIONS reserves the right to cancel any order in the event of a payment error, an existing dispute with the Customer, total or partial non-payment of a previous order by the Customer, refusal of payment authorization by bank card, or for any other legitimate reason. LIZE CREATIONS will not be liable in this regard.


Article 5.2. Transaction Security


To ensure secure payments, the website www.zede-paris.fr uses the Stripe secure payment service. Confidential data (the 16-digit bank card number, the expiry date, and the security code) are transmitted directly and encrypted to the bank's server without passing through the physical server of LIZE CREATIONS.

Once the order is validated, the payment request is routed in real time to the Stripe Secure Payment Manager. The latter sends an authorization request to the bank card network. The electronic payment manager then issues an electronic certificate.

Article 5.3. Reservation of ownership


The items remain the property of LIZE CREATIONS until full payment of the price.


Article 6: DELIVERY
Article 6.1. Shipping and Delivery Time


Items are delivered within 1 to 7 business days from the day after the customer confirms their order, throughout mainland France. This timeframe includes order preparation and shipping time. It is provided for informational purposes only and may vary depending on product availability. LIZE CREATIONS cannot be held liable for any delays beyond this timeframe, nor will they give rise to contract cancellation or any claim for damages.


In the event of transport problems, postal service issues or force majeure, LIZE CREATIONS declines all responsibility for delivery delays.

The items are delivered to the address specified on the order form provided by the Customer. The Customer assumes all transport risks from the moment the goods are handed over to the carrier. In the case of delivery to a shared address, LIZE CREATIONS has no obligation, as the goods arrive at the address indicated, even if received by a third party.


In the event of the customer's absence at the delivery address indicated in the order form, or an incorrect address due to an omission or typo, LIZE CREATIONS reserves the right to charge for the delivery service according to the different delivery methods offered below in article 6.2.


Article 6.2. Delivery Method


When placing an order, the Customer is asked to choose their preferred shipping method from among the providers selected by LIZE CREATIONS. The providers offered are:

- Postal service: 48 to 72 hours on business days, from the date of dispatch *
-> The price varies depending on the weight
- Pickup Point: 3 to 6 business days from dispatch
-> The price varies depending on the weight

These methods are currently available for France and Europe.


Delivery is free for all orders over 80 euros (only Pickup Points are free)


Article 7: RIGHT OF WITHDRAWAL


All products sold are covered by a "satisfaction guaranteed or your money back" policy. In accordance with Article L.121-21 of the French Consumer Code, the Customer has a 14-day right of withdrawal to return products without having to provide a reason. The withdrawal period begins on the day the Customer, or a third party designated by them, receives the package.


Return shipping costs are the responsibility of the customer.


LIZE CREATIONS reserves the right to request the delivery note as proof.

To exercise their right of withdrawal, the Customer must return the item(s) within 14 days of receipt. Customer service must be contacted beforehand to obtain return instructions and ensure the item(s) are returned correctly.

The Customer is required to return the item(s) within 14 days from the day LIZE CREATIONS is informed of their decision to withdraw.


If the Customer requests a return, LIZE CREATIONS will proceed with an exchange, a credit note, or a full refund of the price of the item(s) within 14 days of the date on which the seller was notified of the Customer's return. In any event, this refund cannot be issued until LIZE CREATIONS has received the returned item(s) or until the Customer has provided proof of return.


In the event of a refund request, the payment method will be the same as that chosen when ordering unless otherwise agreed by the customer with LIZE CREATIONS.


Refund will only be accepted on the condition that the item(s) concerned have not been depreciated as a result of handling other than that necessary to establish its nature, characteristics and/or conformity.


Article 8: WARRANTY


Article 8.1. Legal guarantee of conformity and guarantee against hidden defects


The products sold on the Site are subject to the legal guarantee of conformity (Article L 211-4 et seq. of the French Consumer Code) and the guarantee against hidden defects (Articles 1641 and 1648 of the French Civil Code). All guarantees are excluded in the event of normal wear and tear of the product, defects and damage of external origin, or due to misuse, abuse, negligence, or lack of maintenance by the Customer.

The seller is required to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery (...).

To be compliant with the contract, the goods must:


1. To be fit for the usual use of a similar item and, where applicable:


- correspond to the description given by the seller and possess the qualities that he presented to the buyer in the form of a sample or model;


- to present the qualities that a buyer can legitimately expect, given the public statements made by the seller, the producer or their representative, particularly in terms of advertising or labelling;

2. Or have the characteristics defined by mutual agreement between the parties or be suitable for any particular purpose sought by the buyer, brought to the attention of the seller and which the latter has accepted.


Article L211.7 Consumer Code


Any lack of conformity that appears within six months of delivery of the goods is presumed to have existed at the time of delivery, unless proven otherwise. The seller may rebut this presumption if it is incompatible with the nature of the goods or the alleged lack of conformity.

Article L211.10 Consumer Code


If repair and replacement of the property are impossible, the buyer may return the property and recover the price or keep the property and obtain part of the price.


He is offered the same option:


1° If the solution requested, proposed or agreed upon pursuant to Article L.211-9 cannot be implemented within one month of the buyer's claim;
2° Or if this solution cannot be without major drawbacks for the latter, given the nature of the property and the use it seeks.
However, the sale cannot be rescinded if the non-conformity is minor.


Article L211-12 of the Consumer Code


The action resulting from the lack of conformity is time-barred after two years from the delivery of the goods.


Article L211-13 of the Consumer Code


The provisions of this article do not deprive the buyer of the right to exercise the action resulting from hidden defects as provided for in Articles 1641 to 1649 of the Civil Code or any other action of a contractual or extra-contractual nature recognized to him by law.


Article 1641 of the Civil Code: The seller is bound by the warranty for hidden defects in the thing sold which render it unfit for the use for which it is intended, or which diminish this use to such an extent that the buyer would not have acquired it, or would have given a lower price if he had known of them.


Article 1648, paragraph 1 of the Civil Code: The action resulting from latent defects must be brought by the purchaser within two years of the discovery of the defect. In the case provided for in Article 1642-1, the action must be brought, under penalty of forfeiture, within one year of the date on which the seller can be released from liability for apparent defects.


Article 8.2 Return and refund of defective or non-conforming products


Any return or refund requested by the Customer involving legal guarantees of conformity or hidden defects must remain in the form of explanatory letters and be sent to LIZE CREATIONS by mail, with acknowledgment of receipt, to the following address: 81 rue du Temple, 75003 PARIS.


After verifying the defect or non-conformity of the returned item, LIZE CREATIONS will proceed with an exchange or refund to the Customer of the full price of the items concerned, the return costs, and including the shipping costs if the return concerns the entire order.


Article 8.3. Producer's Guarantee


LIZE CREATIONS guarantees the items sold for a period of 2 years from the purchase date indicated on the invoice. The manufacturer's warranty is intended to cover even defects resulting from customer use. This warranty will allow the customer to benefit from more comprehensive protection against potential defects and/or damage compared to the statutory warranty.


The warranty takes the form of a free repair service for 2 years following purchase. Shipping costs are the responsibility of the customer.
The defects in question are those of the accessories (buckles, snap fasteners and studs)


Fabric fading is not covered by the manufacturer's warranty, as excessive exposure of fabric items to sunlight naturally leads to irreversible discoloration. Damage caused by improper handling (tears, burns, holes and cuts, stained or scratched fabric or leather) is also excluded from the manufacturer's warranty.


Article 9: INTELLECTUAL PROPERTY


All visual and audio elements of the website www.zede-paris.com are the exclusive property of LIZE CREATIONS and are protected by copyright. Consequently, any copying, publication, distribution, or use not previously authorized by LIZE CREATIONS is strictly prohibited and constitutes copyright infringement punishable by law.


In any event, any link from our site, even if tacitly authorized, must be removed upon simple request from LIZE CREATIONS.


Article 10: DATA PROTECTION (GDPR)


For the proper execution of the order, the personal data collected relating to the consumer will be subject to computer processing.
As such, information concerning him may be shared with LIZE CREATIONS' business partners. We strive to comply with the GDPR.
The buyer may object to the disclosure of their contact information by contacting customer service. In accordance with the French Data Protection Act of 6 January 1978, the buyer also has the right to access and rectify their personal information. This data processing has been declared to the CNIL (French Data Protection Authority).


Article 11: SELLER'S LIABILITY

LIZE CREATIONS is only bound by an obligation of means in the online sales process. It cannot be held liable for damages resulting from the use of the Internet, including data loss, external intrusions, the presence of computer viruses, service interruptions, or other unintentional problems.


Article 12: APPLICABLE LAW AND VALIDITY OF THESE GENERAL TERMS AND CONDITIONS OF SALE


These terms and conditions of sale are governed by French law. In the event of a dispute, the French courts shall have jurisdiction, even if the buyer accesses the website www.zede-paris.com from a country other than France.
